1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your access to and use of the platform operated by The Akari Group LLC, a Delaware limited liability company, doing business as ("d/b/a") Art Continum ("Platform," "Website," "we," "us," or "our").
The Akari Group LLC operates in Ghana through its affiliated entity The Akari Group Limited (Ghana), which acts as LLC's agent for shipping coordination, local operations, and artist relations in Ghana. All contracts are with The Akari Group LLC.
By accessing, browsing, or purchasing from the Platform, you ("User," "Buyer," "you") agree to be bound by these Terms. If you do not agree, you may not use the Platform.
The Akari Group LLC reserves the right to modify these Terms at any time. Continued use of the Platform after modifications constitutes acceptance of updated Terms.
2. PLATFORM DESCRIPTION
Art Continum represents the African art continuum — the unbroken flow of creativity across time, geography, and medium. The Platform facilitates the sale of and access to:
- Browse Art: Contemporary fine art and traditional craft by African and diaspora artists
- The Bazaar: African cultural artifacts, traditional textiles, handcrafted collectibles, vintage Afro-centric items, cultural heritage objects, and artisan goods
- Inside the Continuum: A flagship editorial series combining long-form cultural storytelling with curated commercial resources — including artworks available for acquisition, cultural experiences, travel planning resources, event access, and related merchandise. Features may include affiliate relationships with third-party providers (see Section 7A)
- Stories: Editorial content exploring artist journeys, cultural contexts, traditional practices, and narratives that illuminate African creativity
- News: Updates on platform activities, artist achievements, cultural events, and developments across the African art community
All artwork transactions are managed by Art Continum. The Platform acts as intermediary between artists/vendors and buyers for marketplace purchases. Stories, News, and Inside the Continuum editorial content are provided free of charge. Some Inside the Continuum features contain affiliate links and commercial offerings governed by Section 7A.

7.1 Nature of Items
Items in The Bazaar section include African cultural artifacts, traditional textiles, handcrafted collectibles, vintage Afro-centric products, cultural heritage objects, and artisan goods. Unless explicitly marked "ORIGINAL" or "AUTHENTIC ANTIQUE," items are replicas, reproductions, or decorative pieces.
7.2 No Authentication Guarantee
Art Continum does not provide professional authentication services for Bazaar items. Items are sold for decorative and collectible purposes.
7.3 Cultural Heritage Compliance
Art Continum complies with all applicable laws regarding cultural heritage and export restrictions. Buyers are responsible for ensuring compliance with import regulations in their jurisdiction.
7.4 Cultural Artifacts & Vintage Items
Cultural artifacts, traditional textiles, and vintage collectibles are sold as-is. Natural variations in condition, age-related wear, patina, and authenticity are expected. Items marked "vintage" or "antique" reflect the vendor's representation only; the Platform does not independently verify age or authenticity unless explicitly stated.
7.5 Cultural Respect in Editorial Content
Stories and News content about traditional practices, ceremonies, and sacred objects are created with cultural sensitivity and, where appropriate, guidance from cultural practitioners. Art Continum respects the boundaries of what should and should not be publicly documented.
7A. INSIDE THE CONTINUUM — EDITORIAL COMMERCE TERMS
7A.1 Nature of Inside the Continuum
Inside the Continuum is an editorial series produced by Art Continum that combines long-form cultural storytelling with curated commercial resources. Features may include artworks available for direct purchase, affiliate links to third-party providers, tour and experience packages operated by Art Continum or its partners, event tickets, merchandise from The Bazaar, and book or resource recommendations.
7A.2 Affiliate Relationship Disclosure
In compliance with applicable disclosure requirements, Art Continum discloses that Inside the Continuum features may contain affiliate links to third-party services including but not limited to hotel booking platforms, flight booking aggregators, book retailers, and travel service providers. Art Continum may receive a commission when users complete transactions through these links at no additional cost to the user.
Curated Resources, Cultural Planning Guides, and similar designations within Inside the Continuum features may include affiliate-compensated links. The presence of an affiliate relationship does not influence Art Continum's editorial recommendations; all resources are selected on the basis of cultural relevance and quality.
7A.3 Editorial vs. Commercial Content
Inside the Continuum features are editorial in nature. The curatorial perspective, cultural analysis, and recommendations represent Art Continum's genuine assessment. Commercial offerings embedded within features — including artwork listings, affiliate links, and experience bookings — are clearly demarcated as pathways to engagement and do not constitute endorsements of specific financial outcomes.
7A.4 Third-Party Affiliate Platforms
Transactions completed through third-party affiliate platforms (including hotel bookings, flight bookings, and book purchases) are governed by the terms and conditions of those third-party platforms. Art Continum is not a party to such transactions and accepts no liability for disputes, non-delivery, pricing errors, or service failures arising from third-party bookings.
Users should review the terms and conditions of any third-party platform before completing a transaction. Refund and cancellation policies for third-party bookings are governed by those platforms, not by Art Continum.
7A.5 Recommendations Disclaimer
Cultural recommendations, itineraries, travel guidance, and resource suggestions within Inside the Continuum features are provided for informational and cultural enrichment purposes only. They do not constitute professional travel advice, financial advice, or guarantees of experience quality. Art Continum accepts no liability for decisions made on the basis of editorial recommendations.
7A.6 Intellectual Property in Features
All Inside the Continuum editorial content, including text, photography, interviews, and multimedia, is owned by The Akari Group LLC unless otherwise stated. Users may share links to features via social media or personal communication. Reproduction, republication, or commercial use of feature content without written permission is prohibited.
7B. TRAVEL & EXPERIENCE BOOKINGS
7B.1 Art Continum-Operated Experiences
Art Continum and The Akari Group LLC operate cultural travel experiences, including festival tours, studio visit packages, collector trips, and curated cultural journeys (collectively, "Experiences"). These are distinct from third-party affiliate bookings governed by Section 7A.
7B.2 Booking & Payment
Experience bookings require a deposit or full payment at the time of reservation. Pricing, inclusions, and payment schedules are specified at the point of booking. All Experience pricing is in USD unless otherwise stated.
7B.3 Cancellation & Refund Policy for Experiences
- Cancellations made more than 30 days before the Experience date: full refund less a 10% administrative fee
- Cancellations made 15 to 30 days before: 50% refund
- Cancellations made fewer than 15 days before: no refund
Art Continum reserves the right to cancel or modify Experiences due to insufficient bookings, safety concerns, or force majeure, in which case participants will receive a full refund or credit toward a future Experience.
7B.4 Liability for Experiences
Art Continum takes reasonable care in curating and operating Experiences. However, Art Continum is not liable for personal injury, loss, or damage sustained during an Experience unless caused by Art Continum's direct negligence. Participants are responsible for their own travel insurance, health insurance, and personal safety. Art Continum strongly recommends comprehensive travel insurance for all Experience participants.
7B.5 Third-Party Experience Components
Experiences may include components delivered by third-party providers including accommodation providers, local guides, transport operators, and cultural institutions. Art Continum is not liable for the acts or omissions of third-party providers, though we select partners with care.
7B.6 Force Majeure for Experiences
Art Continum is not liable for cancellation or modification of Experiences caused by events beyond its reasonable control, including but not limited to natural disasters, civil unrest, government travel restrictions, pandemics, or acts of God. In such cases, Art Continum will make reasonable efforts to reschedule or provide credit.
7B.7 Participant Conduct
Experience participants agree to conduct themselves respectfully toward local communities, cultural practitioners, artists, and other participants. Art Continum reserves the right to remove participants from an Experience for conduct deemed disrespectful or disruptive, without refund.
7C. EVENT TICKETS
7C.1 Art Continum Events
Art Continum produces and promotes events including artist talks, exhibition openings, collector gatherings, studio visits, and cultural programming. Tickets for Art Continum-produced events are sold through the Platform or designated ticketing channels.
7C.2 Ticket Refund Policy
Tickets for Art Continum events are non-refundable unless the event is cancelled by Art Continum. In the event of cancellation by Art Continum, ticket holders will receive a full refund or credit toward a future event. Event dates and programming are subject to change; changes do not entitle ticket holders to a refund unless the event is cancelled entirely.
7C.3 Partner & Third-Party Events
Art Continum may promote or provide links to events produced by third-party organisations including galleries, museums, art fairs, and cultural institutions. For third-party events, ticket purchase and refund terms are governed by those organisations. Art Continum is not a party to third-party event transactions and accepts no liability for third-party event cancellations, changes, or disputes.
7C.4 Event Access
Tickets are non-transferable unless explicitly stated otherwise. Art Continum reserves the right to refuse entry to events for conduct violations or fraudulent ticket acquisition.
8. BUYER OBLIGATIONS & CONDUCT
8.1 Accurate Information
Buyers must provide accurate shipping, billing, and contact information.
8.2 Prohibited Conduct

- Harass, threaten, or abuse Platform staff or artists
- Attempt to circumvent Platform processes or contact artists directly for sales
- Use the Platform for money laundering or illegal activities
- Submit false claims regarding item condition or authenticity
8.3 Direct Artist Contact
If a buyer contacts an artist directly (bypassing the Platform) for any transaction or dispute, Art Continum is not responsible for any issues, damages, fraud, non-delivery, or disputes arising from such direct dealings. Direct buyer-artist transactions are at the parties' own risk.
8.4 Inspection Duty
Buyers must inspect packages immediately upon delivery and report any issues within 72 hours. Failure to inspect and report within the 72-hour window waives the right to claim damage or defects.
8.5 Communication
All official communication must be via email to info@artcontinum.com. Art Continum responds to enquiries within 48 hours.
9. HIGH-VALUE PURCHASES ($1,000+)
For purchases of $1,000 USD or more, buyers may request:
- Additional photographs of the artwork
- A video call to view the artwork in detail
- Additional condition reports
Requests must be made before purchase completion. Art Continum will accommodate reasonable requests within 48 hours.
10. INTELLECTUAL PROPERTY
10.1 Platform Ownership
All content on the Platform, including but not limited to text, images, logos, design, software, Stories, News articles, Inside the Continuum features, and editorial content, is the property of The Akari Group LLC or its licensors. Unauthorised use is prohibited.
10.2 No Downloads
Users may not download, reproduce, copy, distribute, or create derivative works from any images or content on the Platform without express written permission.
10.3 Artist Copyright & Reproduction Rights
Artists retain full copyright in all their works. Purchase of artwork conveys ownership of the physical artwork only. Copyright and all reproduction rights remain with the Artist unless explicitly transferred in a separate written agreement signed by both Artist and Buyer.
What Artists May Do: After selling an artwork through Art Continum, Artists retain the unrestricted right to create prints, editions, or reproductions of the sold work; license the artwork image for commercial use; use artwork images in their portfolio, website, social media, grant applications, and promotional materials; include artwork images in published books, catalogues, or exhibitions; and create derivative works inspired by the sold artwork.
What Buyers May Do: When you purchase an artwork, you may display, photograph, and enjoy the physical artwork; include the artwork in personal photography or documentation of your collection; resell the physical artwork (subject to resale royalty obligations for Exclusive Artists per Section 10.6); and display photographs of your artwork on personal social media with appropriate artist credit.
What Buyers May NOT Do: You may not reproduce the artwork for commercial purposes; create prints, posters, or merchandise featuring the artwork; license or sell reproduction rights to third parties; remove, alter, or obscure the artist's signature or attribution; create derivative works based on the artwork; or use artwork images for advertising, marketing, or commercial purposes without the Artist's written permission.
Special Designation: Unique/One-of-a-Kind Works: Artworks specifically designated and sold as "Unique/One-of-a-Kind" will be clearly marked in the listing and Certificate of Authenticity. For these specially designated works only, the Artist agrees not to create reproductions or editions without your written consent. This designation is rare and will be prominently displayed when applicable.
Licensing Requests: If you wish to license reproduction rights or use artwork images for commercial purposes, contact info@artcontinum.com to facilitate an agreement with the Artist. Art Continum may assist in negotiations but is not a party to such licensing agreements.
10.4 Watermarked Images
All images on the Platform are watermarked or otherwise protected. Unauthorised use constitutes copyright infringement.
10.5 DMCA Compliance
Art Continum complies with the Digital Millennium Copyright Act. Copyright infringement claims should be sent to info@artcontinum.com.
10.6 Resale Royalty Rights (Exclusive Artists Only)
For artworks purchased from Exclusive Represented Artists, if you resell the artwork through any channel (private sale, auction house, gallery, or any other means), you agree to pay the original Artist five percent (5%) of the gross resale price within thirty (30) days of completing the resale transaction, and to notify Art Continum at info@artcontinum.com and the Artist in writing within thirty (30) days of the resale.
This resale royalty obligation runs with the artwork for its lifetime and applies to all subsequent owners. By purchasing an artwork from an Exclusive Represented Artist, you agree to inform any future buyer of this continuing obligation and include it in any bill of sale or transfer documents.
Works purchased from Non-Exclusive Representation Artists or Marketplace Artists are NOT subject to any resale royalty obligation.
All Certificates of Authenticity for Exclusive Artist works will include notation of the resale royalty obligation to ensure all parties are informed.
10.7 Editorial Content Rights
All Stories, News, and Inside the Continuum content, including text, photographs, videos, and interviews, are protected by copyright and owned by The Akari Group LLC unless otherwise indicated. Users may not reproduce, republish, or redistribute editorial content without written permission, use editorial content for commercial purposes, or remove attribution or copyright notices. Sharing links to editorial content via social media or personal communication is permitted.

Inside the Continuum features may contain affiliate relationships and commercial recommendations. These recommendations are made on the basis of cultural relevance and editorial judgement. Art Continum does not warrant the quality, accuracy, or fitness for purpose of any third-party product or service recommended or linked within editorial features. The inclusion of a commercial resource within editorial content does not constitute a guarantee of the quality or suitability of that resource for any particular purpose.
11.8 Travel & Experience Disclaimer
Cultural experiences, travel itineraries, and festival guidance provided within Inside the Continuum features or through Art Continum-operated Experiences are provided in good faith.
